Excerpts From Other First Nation Self Government Agreements

Note: The Self Government question for the Algonquins of Pikwakanagan First Nation is still in the works with respect to a decision. With that in mind the following is provided as food for thought. Across Canada about 25 First Nations have entered into different types of Self Government Agreements (SGA). There are also currently about 90 other Self Government negotiations tables going on. In the Yukon Territory 11 of the 14 First Nations there have entered Self Government Agreements (SGA’s) with Canada and the Government of the Yukon. These particular Yukon SGA’s are all quite similar. The Vuntut Gwichin First Nation is one of them. The following are some excerpts from their SGA dated May 29, 1993. Prior to the SGA and the Legislation enacting the SGA the Vuntut Gwichin were a Band under the Indian Act and like us were a legal entity under the Indian Act. Section 9.0 outlines the “Legal Status of the Vuntut Gwichin First Nation” under the SGA. Paragraph 9.1 reads as follows: “9.1. Upon the Effective Date, the Indian Act, R.S.C, c.1-5, Vuntut Gwichin Tribal Band shall cease to exist and it rights, titles, interests, assets, obligations and liabilities, including those of its band council, shall vest in the Vuntut Gwichin First Nation. Paragraph 9.2 reads, in part that “The Vuntut Gwichin First Nation is a legal entity…” So what are these two paragraphs actually saying? Paragraph 9.1 is saying that the Vuntut Gwichin Indian Act band ceases to exist as a band under the Indian Act! But it also says that all the rights, title, interests and powers of that former Indian Act band are transferred to the now recognized Vuntut Gwichin First Nation under the SGA. They are recognized as a First Nation just that the recognition comes under a different Government Act! [for your info the Indian Act right now does not say we are a First Nation it calls us an Indian band] Paragraph 9.2 tells us that the now recognized Vuntut Gwichin First Nation is also a recognized legal entity with similar legal status and powers (actually more powers) than when they were a Band under the Indian Act!

For the Yukon First Nations who have signed SGA’s these Agreements they are further ratified by a Yukon First Nations Self-Government Act (Canada) and the First Nations (Yukon) Self-Government Act. They are Governments Acts just like the Indian Act is a Government Act! Chapter 10 of the Vuntut Gwichin SGA talks about the Vuntut Gwichin First Nation Constitution. The following is an excerpt from that Chapter. “10.1 The Vuntut Gwichin First Nation Constitution shall: 10.1.1. contain the Vuntut Gwichin First Nation citizenship code:” This provision says that there will be a First Nation citizenship code. Such a code will have been developed and approved by the Vuntut Gwichin First Nation and its Citizens. It is different from the Indian Act Status provisions which we fall under. They do decide their own First Nation membership! So let’s summarize this. The Vuntut Gwichin are now legally recognized as a First Nation (not just a band) by Government just under a different Government Act instead of the Indian Act. They are still recognized as a legal entity but with more powers and responsibilities. They determine their own Citizens/members pursuant to the Citizenship Code they develop and approve under their Constitution as recognized by Section 10 of their SGA. For us, the AOPFN, right now if you do not meet the Indian Act status criteria you are not a member of our First Nation and are not recognized by Government! So the Federal and Territorial Governments do recognize the Vuntut Gwichin as a First Nation and they do recognize their Members/Citizens as Members/Citizens of their First Nation! Some Basic Facts About the

Indian Status Provisions of the Indian Act.

The following is provided for your information. It is to give you a basic understanding of how the Indian Status provisions of the Indian Act work and how they may be affecting you and your family right now.

These Indian Act Status provisions determine whether you, your children or your grandchildren will be Status Indians or NOT. If your children or grandchildren are not Status Indians then they will not be Members of the First Nation.

All Members are either 6(1) or 6(2) Status. If you are not one of these then you are not a Member. There are currently many Members who do not have 6(1) Indian Status. Since April 1985; -a person with 6(1) Indian Status can pass on Indian Status to their children. -however, if that 6(1) Status Indian has child with a person who does not have Indian Act Status (ie. you might call them not an Indian or not Native) then that child will be a 6(2) Indian Status person. -and this means that the 6(2) Status Indian can only pass on Indian Status to his/her child if he/she has a child with another person who is a Status Indian. -If that 6(2) Status Indian has a child with a person who is not a Status Indian (ie. a Non-Indian including a non-Status Indian person) that child will not be a Status Indian. To put it bluntly if they have a child with a person who does not have Indian Act Status that child will not be a Status Indian.

There are some exceptions to these rules but these will apply in the good majority of cases to all of us. Do these rules affect you, or your children, your grandchildren or future grandchildren? If you are unsure of the Indian Act Status (and therefore First Nation membership!) of yourself, your children or grandchildren then we encourage you to find that out. We suggest that you do not assume that your children and grandchildren have or will have Indian Status. Chief and Council

First Nation Transitional Support Fund

The Social Services Department has been able to access funding from the First Nation Transitional Support Fund to help offset some of the costs with increased electricity and heating prices. The funding is intended to be accessed by Low Income Households within the First Nation however; it may also be available to Ontario Works and ODSP recipients who are not eligible for discretionary benefits through Ontario Works. The funding is limited for payment of:

Energy Arrears Reconnection Fees

The funding will be distributed on a “first come-first served” basis, by proof of low income and energy invoices (Hydro One bills). This funding is only available while it lasts and must be expended by March 31, 2016. If you are granted an appointment, the following documents are required by you for application processing:

ANIMAL CONTROL OFFICER

Tenders for animal control services in Pikwakanagan will be accepted at the

Administration Office until Thursday, March 31, 2016 at 4:30 p.m.

Responsibilities:

Respond to resident calls regarding domestic animals, immediately or within a reasonable time;

Capture and transport animal to owner or shelter using appropriate equipment;

Investigate complaints and incidents of animal bites, noise, attacks, etc;

Validate tag and identify and contact owner in all reported cases, if possible;

Complete, submit and/or issue warning, notices, summons, complaints and reports.

Requirements:

Experience and education in animal services or by-law enforcement is an asset;

Must be accessible at all times by phone, cell phone, pager, etc;

Must own or have access to a dependable vehicle;

Must supply own equipment i.e poles, gloves, muzzle, cages, etc;

Must be able to lift and carry heavy animals - up to 50 lbs;

Must be able to communicate effectively orally and written;

Must not have any allergies to animals;

Must provide proof of valid class “G” Ontario driver’s licence and insurance with tender.

If bidding as a company, all employees must meet the above requirements

and the company name provided with insurance coverage for their employees.

The Tender Must:

1. Set the price or flat rate that will be invoiced bi-weekly regardless of the amount of activity.

2. Set the mileage price or flat rate for travel to Eganville.

New Post Secondary Students and Returning Students The Post Secondary Policy is under revision. Please note the following updates, are supported by Chief and Council.

New Deadline Date to receive applications is May 15th due to changes in Institution requirements. All documents must be received by the due date of May 15th this includes transcripts for current college and university students.

Secondary Students Only – only secondary students have the opportunity to defer their funding for one year. The Letter of Deferral must be received and approved by May 15th as this will affect your priority status. New Levels of Funding

UCEP students will be funded for one year. This provides the opportunity for new students to explore their career choice without affecting their levels. This would include pre-programs as required by the institutions
